Cal. Civ. Code § 0770-01-04-.05
ANCILLARY FACILITIES.
Operative Text
To the extent economically feasible and appropriate to the proposed housing development and the neighborhood or market area in which it is to be located, the Agency will encourage the coordinated planning and development of administrative, community recreational, commercial, and other non-housing facilities in conjunction with housing developments it finances. However, the Agency’s notes and bonds are required to be issued primarily for housing purposes, and the Agency staff and Agency Board will exercise reasonable judgement in reviewing and approving applications for proposed housing developments in which such ancillary facilities constitute a portion. Authority: T.C.A. §13--23--115 (18). Administrative History: Original rule filed September 19, 1975, effective October 19, 1975.
Under Tenn. Comp. R. & Regs. 0770-01-04 § 0770-01-04-.05, the Tennessee Housing Development Agency (THDA) is authorized to encourage the inclusion of non-housing facilities—such as community, commercial, and administrative spaces—alongside residential developments it finances, provided doing so is economically feasible and appropriate to the local context. Because the Agency's financing instruments must remain primarily housing-focused, any ancillary facilities can only constitute a portion of a proposed development. The Agency's staff and Board apply reasonable judgment when reviewing applications that include such non-housing components.
Plain English — not legal advice.
Developers and property owners seeking THDA financing under § 0770-01-04-.05 should understand that the Agency looks favorably on coordinated planning that integrates community, recreational, or commercial spaces into housing developments when those additions are economically feasible and contextually appropriate. Because THDA notes and bonds must be issued primarily for housing purposes, ancillary facilities cannot be the dominant component of a proposed project. Operators generally document how any non-housing elements serve the broader residential mission and fit the surrounding neighborhood or market area when submitting applications for Agency review.

Section 0770-01-04-.05 reflects a policy that THDA-financed housing developments may include community, recreational, and commercial amenities beyond just residential units, which can affect the services and spaces available within a given development. Tenants living in or considering THDA-financed properties may find that on-site amenities were shaped by this provision's feasibility and appropriateness standards. Those with questions about how ancillary facilities in a specific development were approved can contact THDA directly or reach out to a local tenant-rights organization for general guidance.
