Tenn. Comp. R. & Regs. 0770-01-04 § 0770-01-04-.04 establishes a framework for how housing sponsors are regulated by the Tennessee Housing Development Agency. Organizations seeking to become housing sponsors must submit their foundational governing documents for Agency review and approval before proceeding. Once approved, sponsors must enter into a Regulatory Agreement before any Agency mortgage loan can close, giving the Agency authority to oversee development, construction, and operations. The Agency may also set requirements around equity retention, operational standards, and working capital escrows to help ensure the long-term stability of financed housing developments.

Property owners and developers seeking Agency financing under § 0770-01-04-.04 generally ensure that their organizational documents—such as articles of incorporation or partnership agreements—are submitted to the Executive Director for review and approval before advancing in the loan process. Compliant operators execute a Regulatory Agreement with the Agency prior to the initial mortgage loan closing, which grants the Agency oversight authority over development and operational matters. Operators also typically maintain any equity positions, operational standards, and working capital escrows that the Agency establishes as conditions of financing.

While § 0770-01-04-.04 primarily governs the relationship between the Tennessee Housing Development Agency and housing sponsors, it has indirect relevance to tenants living in Agency-financed developments. The Regulatory Agreement required under this provision gives the Agency ongoing authority to oversee how those housing developments are operated, which can serve as a structural protection for residents. Tenants who have concerns about the management or conditions of an Agency-financed property may wish to contact the Tennessee Housing Development Agency or consult a local tenant-rights organization to understand what oversight mechanisms may apply to their situation.
