Cal. Civ. Code § 0770-01-01-.05
FEDERALLY ASSISTED MORTGAGE LOANS.
Operative Text
When a housing development or housing unit is financed by an Agency mortgage loan, which Agency mortgage loan, in whole or in part, is a federally insured mortgage or is otherwise assisted or aided, directly or indirectly, by the Federal government, the Agency’s action in authorizing such an Agency mortgage loan shall have the effect of adopting as the Agency’s rules and regulations as to the housing development or housing unit financed by such Agency mortgage loan, or the part thereof which is assisted or aided by the Federal government as aforesaid, rules and regulations provided in the Federal government program pursuant to which the Agency mortgage loan or part thereof is asisted or aided by the Federal government as aforesaid, to the extent not inconsistent with the provisions of the Act, including particularly rules and regulations as to the income limitations for initial occupancy of the subject housing development, housing unit or part thereof, but only to extent that any provision of these Rules and Regulations is consistent with the provisions of such Federal Rules and Regulations. Authority: T.C.A. §13--23--115 (18). Administrative History: Original rule filed June 24, 1974; effective August 23, 1974.
Under Tenn. Comp. R. & Regs. 0770-01-01 § 0770-01-01-.05, when a housing development or unit is financed through an Agency mortgage loan that is federally insured or otherwise receives federal assistance, the federal program's rules and regulations automatically become part of the Agency's own governing framework for that property. This means the federal requirements — including income limits for who may initially occupy the housing — apply alongside state rules, but only where the two sets of rules do not conflict. State rules yield to federal requirements in areas of inconsistency, and federal rules apply only to the portion of the project actually receiving federal assistance.

Operators of housing developments financed under a federally assisted Agency mortgage loan covered by § 0770-01-01-.05 generally maintain compliance with both the Tennessee Housing Development Agency's rules and the applicable federal program's requirements simultaneously. Compliant operators typically track income eligibility limits for initial occupancy as defined by the relevant federal program, since those limits are incorporated by reference into the Agency's own regulations for the assisted property. Because the federal and state frameworks must be read together, operators commonly review both sets of requirements when making occupancy and underwriting decisions for the federally assisted portion of a development.

Tenants seeking housing in a development financed by a federally assisted Agency mortgage loan should be aware that § 0770-01-01-.05 means both state Agency rules and the relevant federal program's rules — including income limits for initial occupancy — govern eligibility for that housing. If a tenant believes eligibility determinations or occupancy rules were applied incorrectly, they may have grounds to raise concerns under either the state Agency's framework or the applicable federal program's requirements. Tenant-rights organizations and HUD-approved housing counselors can help individuals understand which federal program applies to a specific development and what protections or complaint processes may be available.
