Cal. Civ. Code § 66-28-523
Eviction notices required for elderly care facilities.
Operative Text
(a) As used in this section: (1) “Facility” means a facility that: (A) Provides housing for older persons, as defined in 42 U.S.C. § 3607(b)(2)(C); and (B) Receives federal financial assistance that subjects it to Section 504 of the federal Rehabilitation Act of 1973 (29 U.S.C. § 794); (2) “New property development” means: (i) Razing a facility to use the real property on which the facility is located for purposes other than to provide housing for older persons, as defined in 42 U.S.C. § 3607(b)(2)(C); or (ii) Renovating a facility in a manner that requires the tenants of the facility to vacate the facility in order to turn the facility into residential housing offered at a market rate; and (3) “Residential tenant” means a residential tenant who has a lease or other agreement to live in a facility and who is fifty-five (55) years of age or older. (b) A landlord shall provide sixty (60) days' notice of termination of tenancy for the purpose of eviction of a residential tenant of a facility if: (1) The tenant has paid the tenant's rent due and is not in arrears on rent payments; and (2) The termination and eviction are to allow for new property development. (c) This section does not abrogate a landlord's right to terminate a tenancy for a violation of another law or of the lease or tenancy agreement.
Tennessee Code Ann. § 66-28-523 establishes a special eviction-notice rule for a narrow category of housing: federally assisted facilities that serve older persons (age 55+). When a landlord seeks to end a tenancy in order to raze or renovate such a facility for non-senior or market-rate housing, the law requires a minimum of 60 days' written notice before eviction—but only for tenants who are current on their rent. The provision does not limit a landlord's ability to terminate a tenancy for lease violations or other legal grounds.
Plain English — not legal advice.
Operators of federally assisted senior housing covered by § 66-28-523 who plan to redevelop or convert their property generally ensure that any eviction notice tied to new property development is delivered at least 60 days in advance and that the affected tenant is current on rent at the time notice is issued. Compliant operators also maintain clear records distinguishing development-driven terminations from terminations based on lease violations, since the 60-day requirement applies only to the former. Keeping documentation of the facility's federal funding status and the nature of the planned development helps demonstrate that the correct notice period was applied.

Residential tenants aged 55 or older living in a federally assisted senior housing facility may be entitled under § 66-28-523 to at least 60 days' notice before being evicted to make way for demolition or market-rate conversion, provided they are current on rent. If a tenant believes they received insufficient notice or that the eviction is being mischaracterized to avoid the 60-day requirement, they may raise the notice deficiency as a defense in eviction proceedings. Tenant-rights organizations and legal aid services familiar with Tennessee landlord-tenant law can help residents of such facilities understand whether this provision applies to their situation.
