S.C. Code Ann. § 27-47-20
Purposes and policies of chapter; liberal construction
Operative Text
(A) This chapter must be construed liberally and applied to promote its underlying purposes and policies. (B) The underlying purposes and policies of this chapter are to: (1) provide for the rights and obligations of manufactured home owners and manufactured home park owners and clarify the law governing the renting or leasing of residential lots in a manufactured home park in which five or more lots are offered for rent or lease; (2) encourage manufactured home park owners and manufactured home owners to maintain and improve the quality of housing.
Section 27-47-20 establishes the foundational purposes of South Carolina's manufactured home park chapter, directing that it be read broadly and applied in a way that advances its goals. The provision identifies two core aims: clarifying the legal rights and duties of both manufactured home owners and park owners in communities of five or more lots, and encouraging all parties to maintain and improve housing quality. Courts and agencies interpreting disputes under this chapter are guided to favor readings that advance these stated purposes rather than narrow or technical ones.
Plain English — not legal advice.
Under S.C. Code Ann. § 27-47-20, park owners operating communities of five or more lots are subject to a chapter designed to clarify their legal obligations alongside the rights of their residents. Because the chapter is to be construed liberally, operators generally benefit from understanding that ambiguous provisions may be read in favor of the chapter's stated goals, including housing quality improvement. Compliant park operators typically document maintenance practices and lease terms in ways that reflect the chapter's dual emphasis on clear legal relationships and quality housing.

S.C. Code Ann. § 27-47-20 establishes that the manufactured home park chapter exists, in part, to protect and clarify the rights of manufactured home owners living in parks with five or more lots. Because the chapter must be construed liberally, tenants may find that its protections are interpreted broadly when disputes arise under other provisions of the same chapter. Residents who believe their rights under this chapter have been affected can explore options such as raising relevant provisions as a defense in a legal proceeding, contacting a South Carolina tenant-rights organization, or consulting with an attorney familiar with manufactured housing law.
