S.C. Code Ann. § 27-47-120
Tenancies not governed by chapter
Operative Text
The following tenancies are not governed by this chapter: (1) in which both a manufactured home and a manufactured home lot are rented or leased by the resident; (2) in which a rental space is offered for occupancy by a vehicle which primarily is designed as temporary living quarters for recreational camping or travel use and which either has its own motor power or is mounted on or drawn by another vehicle; (3) at a manufactured home park in which fewer than five lots are offered for rent or lease.
Section 27-47-120 of the South Carolina Code carves out three categories of tenancies that fall entirely outside the protections and requirements of Chapter 47, which governs manufactured home parks. These exclusions cover situations where both the home and the lot are rented together, where the space is used for recreational vehicles or campers rather than permanent manufactured homes, and where the park contains fewer than five lots available for rent or lease. Any tenancy fitting one of these descriptions is subject to other applicable law but not to the specific rules established by this chapter.
Plain English — not legal advice.
Operators of manufactured home parks in South Carolina should be aware that § 27-47-120 limits the scope of Chapter 47's obligations. Compliant operators generally determine at the outset of any tenancy whether it falls into one of the three excluded categories — combined home-and-lot rentals, RV or recreational vehicle spaces, or parks with fewer than five rentable lots — since those arrangements are not governed by the chapter's requirements. Operators whose parks or rental arrangements do fall outside Chapter 47 still review other applicable state and local laws that may apply to their specific type of tenancy.

If you rent a space in a South Carolina manufactured home park, § 27-47-120 determines whether Chapter 47's tenant protections apply to your situation at all. Residents who both rent the manufactured home and the lot from the same landlord, those occupying spaces with recreational vehicles, or those living in parks with fewer than five lots are excluded from this chapter's coverage. Tenants who are uncertain whether their tenancy falls within or outside Chapter 47 may find it helpful to contact a tenant-rights organization or legal aid provider familiar with South Carolina housing law.
