S.C. Code Ann. § 27-47-110
Applicability of this chapter and Chapter 40 of Title 27
Operative Text
This chapter applies to, regulates, and determines the rights, obligations, and remedies under a rental agreement for a residential manufactured home park lot located within this State. The provisions of the Residential Landlord and Tenant Act in Chapter 40 of Title 27 shall apply to tenancies in manufactured home parks if such application is not inconsistent with or contrary to the provisions of this chapter.
Section 27-47-110 of the South Carolina Code establishes that Chapter 47 of Title 27 is the primary governing law for rental agreements involving residential manufactured home park lots in South Carolina. Where Chapter 47 does not address a particular issue, the broader Residential Landlord and Tenant Act found in Chapter 40 of Title 27 may also apply to manufactured home park tenancies, as long as its provisions do not conflict with Chapter 47. In effect, manufactured home park lot renters and park operators operate under a specialized legal framework that draws from both chapters.
Plain English — not legal advice.
Operators of residential manufactured home parks in South Carolina should be aware that their rental agreements are governed first and foremost by Chapter 47 of Title 27 (§ 27-47-110), rather than solely by the general Residential Landlord and Tenant Act in Chapter 40. Compliant park operators typically review both chapters to understand which obligations and remedies apply, recognizing that Chapter 40 fills gaps only where it does not conflict with Chapter 47. Staying current with both statutory frameworks helps operators structure leases and park policies that align with the correct legal standards.

Tenants renting manufactured home park lots in South Carolina have their rights and remedies defined primarily under Chapter 47 of Title 27, as established by § 27-47-110. Where Chapter 47 is silent on an issue, tenants may also have protections available under the general Residential Landlord and Tenant Act in Chapter 40 of Title 27. Tenants who believe their rights under either chapter have been violated may consider consulting a tenant-rights organization or legal aid provider to understand which provisions apply to their situation and what enforcement paths may be available.
