R.I. Gen. Laws ch. 34-18 § 34-18-3
Supplementary principles of law applicable
Operative Text
(a) Unless displaced by the provisions of this chapter, the principles of law and equity, including the law relating to capacity to contract, mutuality of obligations, principal and agent, real property, public health, safety, and fire prevention, estoppel, fraud, misrepresentation, duress, coercion, mistake, bankruptcy, or other validating or invalidating cause supplements its provisions. (b) This chapter shall apply to any rental agreement involving public housing or any type of federally subsidized or regulated housing except where: (1) A particular subject matter has been pre-empted by federal law, or; (2) A landlord or tenant has any rights or responsibilities derived from federal law or regulations which directly conflict with the provisions of this chapter, in which case the rights and responsibilities derived from federal laws and regulations shall control.
Rhode Island General Laws § 34-18-3 establishes that the state's Residential Landlord and Tenant Act does not operate in isolation — established legal doctrines such as contract law, equity, fraud, agency, and public health principles continue to apply alongside it wherever the Act itself does not specifically address them. The provision also extends the Act's coverage to public housing and federally subsidized or regulated housing, while carving out situations where federal law takes precedence. When a genuine conflict exists between federal law or regulations and Rhode Island's chapter 34-18, the federal rules govern.
Plain English — not legal advice.
Operators of both conventional and federally assisted rental housing should be aware that § 34-18-3 means compliance with chapter 34-18 does not eliminate obligations arising from broader legal doctrines — contract principles, fraud, misrepresentation, and public health law, among others, remain in play. Landlords managing HUD-assisted, Section 8, or other federally regulated properties generally account for both state and federal requirements, deferring to federal rules only where a direct conflict with chapter 34-18 is established. Compliant operators typically maintain familiarity with both layers of law rather than assuming one set of rules displaces the other entirely.

Tenants in Rhode Island — including those living in public housing or federally subsidized units — retain the protections of chapter 34-18 under § 34-18-3, supplemented by longstanding legal principles such as those governing fraud, misrepresentation, and contract validity. Residents of federally assisted housing also retain any rights granted by federal law or regulations, and where those federal rights directly conflict with state law, the federal protections apply. Tenants who believe their rights under either framework have been violated may consider contacting a local tenant-rights organization, a legal aid office, or the relevant housing authority to understand available complaint and enforcement paths.
