Plain English

Under 28 Pa. Code § 20.22, tenements, lodging houses, and boarding houses must connect their toilet facilities to a public sewer system whenever one is lawfully accessible. When no public sewer is available, the property must instead use a private sewage disposal system that meets the construction and maintenance standards set out in Chapter 73 of the Pennsylvania Code. The rule ensures that all such residential facilities have a code-compliant method for handling sewage, whether through a public or private system.

For Property Managers

Operators of tenements, lodging houses, or boarding houses in Pennsylvania should verify whether a public sewer is accessible to the property, because 28 Pa. Code § 20.22 requires connection to that sewer for all toilet facilities when one is lawfully available. If no public sewer is accessible, a compliant operator ensures that any on-site sewage disposal system is both constructed and continuously maintained in accordance with Chapter 73 standards. Routine inspections and maintenance records help demonstrate ongoing compliance with these requirements.

For Tenants

Under 28 Pa. Code § 20.22, residents of tenements, lodging houses, and boarding houses have a right to toilet facilities that are connected to a lawful sewage disposal system — either a public sewer or a Chapter 73-compliant private system. If sewage facilities appear to be absent, improperly connected, or poorly maintained, tenants may consider documenting the conditions and reporting concerns to the local health department or code enforcement authority. Tenant-rights organizations can help residents understand what options are generally available when a landlord may not be meeting this requirement.
