A manufactured home community owner who complies with the

Plain English

Under 68 P.S. § 398.10c, a manufactured home community owner who follows the statutory procedures for handling abandoned manufactured homes is shielded from civil liability arising from the sale, disposal, or destruction of those homes and their contents. This immunity extends to items found inside the home or elsewhere in the community that are associated with it. The protection applies only when the owner has adhered to the full set of procedures the act requires; departures from those procedures can eliminate the immunity.

For Property Managers

For manufactured home community operators, 68 P.S. § 398.10c provides meaningful liability protection when dealing with abandoned homes, but that protection is conditional on strict compliance with every procedural step the act prescribes. Compliant operators typically document each stage of the abandonment determination, follow required notice timelines, and retain records demonstrating adherence before proceeding with any sale, disposal, or destruction. Operators who skip or shortcut any required step risk losing the immunity the section would otherwise provide.

For Tenants

Under 68 P.S. § 398.10c, the immunity a community owner enjoys is not unconditional — it applies only when the owner has properly followed all procedures the act sets out. Tenants or former residents who believe an owner acted on a home or its contents without completing those required steps may have grounds to challenge the owner's claim of immunity. Tenant-rights organizations and legal aid offices familiar with Pennsylvania manufactured housing law can help individuals understand whether the procedural requirements were met in a given situation.
