Cal. Civ. Code § 398.10
In accordance with a lessee's right to invite to the lessee's dwelling
unit such social and business visitors as the lessee wishes, no fee may be charged
for overnight visitors or guests occupying a lessee's manufactured home. However,
if such overnight visitors or guests so frequently remain overnight for residential
purposes so as to increase the number of persons normally living in the unit, the
owner or operator of a manufactured home community may revise the rent due to conform
to the rent paid by other lessees with a like number of members in their household.

Compiler's Note: Section 5 of Act 80 of 2010, which amended section 10, provided that Act 80 shall

Plain English

Under 68 P.S. § 398.10, manufactured home community owners and operators are prohibited from charging any fee simply because a lessee has overnight visitors or guests. However, the rule draws a distinction: if overnight visitors stay so regularly that they effectively become additional permanent residents, the owner or operator may adjust the rent to match what other lessees with a comparable household size pay. This provision applies to new leases and to extensions or renewals entered into after the effective date of Act 80 of 2010.

For Property Managers

Under 68 P.S. § 398.10, compliant manufactured home community operators do not impose guest fees or overnight-visitor charges as a standalone cost. Where operators observe that overnight visitors have transitioned into what appears to be permanent co-residency — meaningfully increasing the household size — they may revise rent to align with the rate charged to other lessees with a similar number of household members, rather than imposing a separate fee. Operators generally document household composition consistently and apply rent adjustments uniformly across comparable households to support compliance with this provision.

For Tenants

Section 68 P.S. § 398.10 gives lessees in manufactured home communities the right to have overnight visitors and guests without being charged a fee for those visits. If a community owner or operator attempts to impose such a charge, tenants may point to this provision as a basis for disputing the fee — for example, by raising it in a written response to the owner or by consulting a tenant-rights organization familiar with Pennsylvania manufactured housing law. Tenants should be aware that the provision does allow rent adjustments (not separate fees) if overnight guests have effectively become long-term residents who increase the household size.
