ORS § 456 § 456.769
Legislative findings.
Operative Text
(1) The Legislative Assembly finds and declares that: (a) The maintenance of a pool of affordable housing for all citizens is a matter of statewide concern. (b) The contracts for many participating properties in this state that are publicly supported housing are about to expire or otherwise terminate. State and local governments need an effective process for assessing these expiring and terminating contracts and determining whether to assume ownership of the participating properties. The assessment and determination process should ensure appropriate statewide uniformity while maintaining local flexibility. The process should also ensure the rights of property owners and tenants to fair treatment as the contracts expire. (2) ORS 456.766 to 456.828 are intended to provide a framework for addressing the withdrawal of participating property from publicly supported housing.
ORS § 456.769 sets out the Oregon Legislative Assembly's formal findings underlying the state's publicly supported housing framework. It recognizes that affordable housing is a statewide concern and that many government-backed housing contracts are nearing expiration, creating a need for a structured, uniform process to assess those contracts and decide whether public entities should take ownership. The provision also signals that the broader statutory scheme (ORS 456.766 to 456.828) is designed to manage the orderly withdrawal of properties from publicly supported housing programs while protecting the interests of both owners and tenants.
Plain English — not legal advice.
ORS § 456.769 establishes the legislative intent behind Oregon's framework for expiring publicly supported housing contracts, which shapes how the rest of ORS 456.766 to 456.828 is interpreted and applied. Property owners with contracts nearing expiration or termination should be aware that the statute explicitly calls for fair treatment of owners throughout the assessment and determination process. Operators of participating properties generally stay informed about applicable state and local review procedures as their contracts approach expiration, since the framework anticipates active governmental assessment of whether to assume ownership.

ORS § 456.769 reflects Oregon's legislative commitment to protecting tenants as publicly supported housing contracts expire or terminate. The provision explicitly names tenant fair treatment as a goal of the process established under ORS 456.766 to 456.828, which governs how properties may be withdrawn from publicly supported housing programs. Tenants living in participating properties whose contracts are nearing expiration may find it useful to review the broader statutory scheme and connect with a local tenant-rights organization to understand what procedural protections may apply to their situation.
