Operative Text

ORS § 105 § 105.452
If applicable under ORS 37.040, the Oregon Receivership Code applies to receiverships commenced under ORS 105.420 to 105.455, except that the provisions of ORS 105.420 to 105.455 control over conflicting provisions of the Oregon Receivership Code.

Plain English

Oregon Revised Statutes § 105.452 establishes that the Oregon Receivership Code (ORS Chapter 37) governs receivership proceedings that are initiated under the residential property receivership statutes (ORS 105.420–105.455), but only when ORS 37.040 makes it applicable. Crucially, if any provision of the Oregon Receivership Code conflicts with the rules set out in ORS 105.420–105.455, the more specific housing receivership statutes take precedence. This creates a layered legal framework where general receivership law fills in procedural gaps, but the specialized housing provisions remain the primary authority.

For Property Managers

Under ORS § 105.452, property owners whose buildings become subject to a receivership action initiated under ORS 105.420–105.455 should be aware that the broader Oregon Receivership Code may also apply to those proceedings. Compliant operators generally familiarize themselves with both the specific housing receivership statutes and the general Oregon Receivership Code, understanding that the housing-specific rules govern whenever the two bodies of law conflict. Staying informed about both frameworks helps operators understand the procedural landscape if a receivership is commenced against a property they own or manage.

For Tenants

ORS § 105.452 is relevant to tenants living in properties that have been placed into receivership under ORS 105.420–105.455, as it clarifies which legal rules govern that process. Tenants in such situations have an interest in understanding that the housing-specific receivership statutes take priority over the general Oregon Receivership Code when conflicts arise, which can affect how a receivership is administered and how tenant protections are applied. Tenants seeking to understand their rights during a receivership proceeding may find it helpful to consult a tenant-rights organization or legal aid provider familiar with Oregon's receivership framework.
