ORS § 90 § 90.518
Provider statement of estimated cost of improvements.
Operative Text
(1) A provider shall give the buyer a statement of estimated costs for all improvements to be made under a contract between the buyer and the provider. The provider shall deliver the statement of estimated costs to the buyer before work commences on any of the improvements covered by the contract. (2) If a provider fails to give a statement of estimated costs or knowingly fails to give a complete statement of estimated costs, a buyer who does not have actual notice of the total cost for an improvement and suffers an ascertainable loss due to the failure by the provider may bring an action to recover the greater of actual damages or $200. (3) Except as provided in ORS 41.740, a statement of estimated costs given under this section is considered to contain all of the terms of the contract between the buyer and the provider. The contents of the statement of estimated costs are the only admissible evidence of the terms of the contract between the buyer and the provider.
Oregon Revised Statutes § 90.518 requires that a provider—typically a contractor or seller offering improvements in a manufactured dwelling or floating home context—give the buyer a written statement estimating the costs of all planned improvements before any work begins. If the provider omits this statement or knowingly provides an incomplete one, a buyer who lacked actual notice of the total cost and suffered a measurable loss may seek the greater of their actual damages or $200. Additionally, the cost statement is treated as the definitive record of the contract's terms, and its contents are generally the only evidence admissible to prove what was agreed upon.
Plain English — not legal advice.
Under ORS § 90.518, providers who contract with buyers for improvements are expected to prepare and deliver a complete, written statement of estimated costs before any work starts on any improvement covered by the contract. Compliant operators ensure the statement is thorough and accurate, since knowingly omitting cost information can expose them to a buyer's claim for actual damages or a statutory minimum of $200. Because the statement is treated as the full contract under § 90.518(3), operators generally make sure every agreed term and cost item appears in the written document before work commences.

ORS § 90.518 gives buyers the right to receive a written estimate of all improvement costs before work begins, and treats that document as the binding record of the contract's terms. If a provider failed to deliver a complete statement and you suffered a measurable financial loss as a result, § 90.518(2) allows you to pursue a claim for the greater of your actual damages or $200.
