ORS § 90 § 90.429
Termination of tenancy for certain rented spaces not covered by ORS 90.505 to 90.850.
Operative Text
(1) If a tenancy consists of rented space for a manufactured dwelling or floating home that is owned by the tenant, but the tenancy is not subject to ORS 90.505 to 90.850 because the space is not in a facility, the landlord may terminate a month-to-month tenancy without a cause specified in ORS 90.392, 90.394 or 90.396 only by delivering a written notice of termination to the tenant not less than 180 days before the termination date designated in that notice. (2)(a) A notice given to terminate a tenancy under subsection (1) of this section need not state a reason for the termination. (b) Notwithstanding paragraph (a) of this subsection, a landlord may include in a notice of termination given under subsection (1) of this section an explanation of the reason for the termination without having to prove the reason. An explanation does not give the tenant a right to cure the reason if the notice states that: (A) The notice is given without stated cause; (B) The tenant does not have a right to cure the reason for the termination; and (C) The landlord need not prove the reason for the termination in a court action.
ORS § 90.429 addresses month-to-month tenancies where a tenant owns a manufactured dwelling or floating home but rents the land or space it sits on, and that space is not located within a qualifying facility covered by ORS 90.505 to 90.850. Under this provision, a landlord who wishes to end such a tenancy without citing a specific cause — such as nonpayment or lease violation — must deliver written notice at least 180 days before the designated termination date. The notice is not required to state a reason, though a landlord may voluntarily include one without being obligated to prove it, provided the notice clearly states that no cause is being asserted, the tenant has no right to cure, and the reason need not be proven in court.
Plain English — not legal advice.
Property owners and managers subject to ORS § 90.429 who rent space to tenants who own their manufactured dwelling or floating home — outside of a facility governed by ORS 90.505 to 90.850 — must provide at least 180 days of written notice before a no-cause termination of a month-to-month tenancy. Compliant operators ensure the written notice is delivered within the required timeframe and, if any reason is voluntarily included, also include the three required clarifying statements: that the notice is without stated cause, that the tenant has no right to cure, and that the reason need not be proven in court. Keeping thorough records of notice delivery and the notice's contents is a practice commonly associated with compliance under this section.

ORS § 90.429 provides important protections for tenants who own a manufactured dwelling or floating home but rent the space it occupies outside of a qualifying facility: a landlord seeking a no-cause termination of a month-to-month tenancy must give at least 180 days of written notice before the termination date. Tenants in this situation may want to review any notice they receive to confirm it meets the statutory requirements, including the proper notice period, since a notice that does not comply with ORS § 90.429 may be subject to challenge. Tenant-rights organizations and legal aid services in Oregon can help individuals understand whether a notice they have received meets the requirements of this provision and what general options may be available.
