Oregon Revised Statutes § 90.388 prohibits landlords from disclosing or threatening to disclose the immigration or citizenship status of an applicant, a tenant, or a household member when the purpose or intent behind that disclosure is to harass, retaliate against, or intimidate that person. A violation of this rule is treated both as a violation under ORS 90.390 — which carries its own remedies — and, for purposes of Oregon's civil rights statute, as an unlawful practice subject to the remedies available under ORS 659A.885. The provision applies to applicants and current tenants alike, as well as to members of their households.

For Property Managers

Under ORS § 90.388, compliant property owners and managers do not use information about an applicant's or tenant's immigration or citizenship status as a tool to pressure, intimidate, or retaliate against that person. Operators generally maintain strict internal policies limiting who may access such information and for what purposes, ensuring it is never weaponized in the context of a tenancy dispute or application denial. Because a violation can trigger remedies under both ORS 90.390 and Oregon's civil rights law at ORS 659A.885, the potential consequences of a misstep in this area are significant.

For Tenants

ORS § 90.388 gives applicants and tenants a clear protection: a landlord who discloses or threatens to disclose your immigration or citizenship status — or that of a household member — in order to harass, retaliate against, or intimidate you has violated Oregon law. A violation of this section can be pursued as a tenancy-related violation under ORS 90.390 and also as an unlawful practice under ORS 659A.885, which opens additional civil remedies. Tenants who believe this protection has been violated may consider contacting a local tenant-rights organization, a legal aid office, or Oregon's Bureau of Labor and Industries, which handles civil rights complaints under ORS 659A.
