OAR 813 § 813-065-0140
Copy of Park Closure Notice to Department; Tenant Contacts
Operative Text
When a facility owner(s) or landlord's agent(s) gives notice of closure of a facility to tenants of the park as required by OAR 813-065-0110, 813-065-0120 or 813-065-0130, the facility owner(s) or landlord's agent(s) shall also furnish all of the following to the Department: (1) A copy of the entire notice given to the tenants. The copy must include copies of any accompanying statutes, rules and local laws, except that instead of the statutes and rules, the facility owner(s) or landlord's agent(s) may provide specific statute and rule number citations. If the facility owner(s) or landlord's agent(s) gives notices with differing content to different categories of tenants, the facility owner(s) or landlord's agent(s) shall furnish to the Department a copy of each such notice given. If local laws apply under OAR 813-008-0130, the landlord shall also furnish a copy of the applicable local laws. (2) A list of the names of all tenants to whom the facility owner(s) or landlord's agent(s) gave the notice, with contact information for each tenant that includes the tenant’s address, space number and phone number.
OAR 813 § 813-065-0140 requires that whenever a manufactured dwelling park owner or their agent issues a closure notice to tenants under the related closure-notice rules, they must simultaneously submit documentation to the Oregon Department of Housing and Community Development. This documentation must include a full copy of every version of the closure notice distributed (along with any accompanying statutes, rules, or local laws, or citations in lieu of the full text), as well as a complete list of all notified tenants with their addresses, space numbers, and phone numbers. The rule ensures the Department has a parallel record of who was notified and what information they received.
Plain English — not legal advice.
Operators subject to OAR 813 § 813-065-0140 generally maintain a practice of preparing the Department submission at the same time closure notices go out to tenants, rather than treating it as a separate follow-up task. A compliant operator typically assembles one copy of each distinct notice version distributed, attaches the relevant statutes and rules (or their citation numbers), includes any applicable local laws, and compiles a tenant roster with each resident's name, mailing address, space number, and phone number. Keeping organized records of which notice version went to which category of tenant helps ensure the Department receives a complete and accurate package.

Under OAR 813 § 813-065-0140, when a park owner or their agent issues a closure notice, they are also required to file copies of that notice and a list of all notified tenants—including contact details—with the Oregon Department of Housing and Community Development. This means the Department should have an independent record of the closure notice and the tenant list, which can be relevant if questions arise about whether proper notice was given or whether the notice content was complete. Tenants who have concerns about a closure notice may find it useful to contact the Department or a tenant-rights organization to understand what was filed and what protections may apply.
