An authority shall issue regulations establishing
eligibility requirements, consistent with the purposes and objectives of this
act, for admission to and continued occupancy in its projects.
Nothing contained in this or the preceding section
shall be construed as limiting the power of an authority with respect to a

the authority, to take possession or cause the appointment of a receiver
thereof, free from all of the restrictions imposed by this or the preceding
section.

Plain English

Under 63 O.S. §§ 1054, 1062, 1063, and 1065, housing authorities in Oklahoma are required to create and publish regulations that set out who qualifies to live in their housing projects, both at the time of initial admission and on an ongoing basis. These eligibility rules must align with the broader goals of the state's housing authority act. Separately, the provision clarifies that if a housing authority defaults on its financial obligations, a creditor or obligee may take possession of a project or have a receiver appointed, and such action is not restricted by the eligibility rules described in this or the preceding section.

For Property Managers

Housing authorities operating projects under 63 O.S. §§ 1054, 1062, 1063, and 1065 are generally expected to adopt written eligibility regulations that govern both initial admission and continued residency, ensuring those standards reflect the statutory purposes of the act. Compliant authorities keep these regulations current, apply them consistently, and make them accessible to applicants and residents. Authorities should also be aware that financing agreements may grant obligees certain rights upon default, including receivership, which operate independently of tenant eligibility rules.

For Tenants

Under 63 O.S. §§ 1054, 1062, 1063, and 1065, tenants and applicants in Oklahoma public housing projects have a right to know the eligibility criteria that govern admission and continued occupancy, as authorities are required to establish and publish those standards. If an applicant or resident believes eligibility rules are being applied inconsistently or contrary to the act's purposes, general enforcement paths may include filing a complaint with the housing authority itself or contacting a local tenant-rights organization for guidance. Residents may also wish to consult with a housing attorney to understand how these provisions interact with any specific eligibility determination they have received.
