Oklahoma Administrative Code § 330:70-5-7 requires property owners participating in OHFA-administered housing programs to follow a broad set of federal equal opportunity and civil rights laws, including the Fair Housing Act, Title VI of the Civil Rights Act, the Age Discrimination Act, Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act, among others. Owners must also comply with applicable state and local laws. Additionally, owners are obligated to cooperate with both OHFA and HUD when those agencies conduct compliance reviews or investigate civil rights complaints.
Plain English — not legal advice.
Under § 330:70-5-7, compliant property owners in OHFA programs maintain policies and practices that align with each of the listed federal civil rights statutes, including nondiscrimination in tenant selection, accessibility requirements, and equal opportunity in housing. Operators generally keep records that demonstrate adherence to these requirements and make them available during compliance reviews. When OHFA or HUD initiates a compliance review or complaint investigation, cooperative participation—including timely responses and document production—is part of the owner's obligations under this provision.

Section 330:70-5-7 establishes that owners in OHFA-administered housing programs must uphold federal civil rights protections, meaning tenants and applicants are entitled to nondiscriminatory treatment on the basis of race, color, national origin, age, disability, and other protected characteristics. If a tenant believes an owner has violated these requirements, they may file a complaint with OHFA or HUD, which are authorized to investigate under this provision. Tenant-rights organizations and fair housing councils can also help individuals understand which federal or state civil rights laws may apply to their situation.
