Plain English

Oklahoma Administrative Code § 330:70-1-7 establishes that the Performance Based Contract Administrator Guidebook — along with any future revisions or amendments — carries the force of regulation and applies to all Covered Units under the program. The provision also formally incorporates a federal Final Rule (24 CFR Part 5 et al., Docket No. FR-4495-F-02) concerning screening and eviction for drug abuse and other criminal activity, as published in the Federal Register on May 23, 2001. By incorporating these documents by reference, the rule ensures that both the Guidebook and the federal screening standards are treated as binding requirements within Oklahoma's housing program framework.

For Property Managers

Property owners and managers overseeing Covered Units under Oklahoma's program should be aware that § 330:70-1-7 makes the Performance Based Contract Administrator Guidebook — including all updates — a binding part of their regulatory obligations. Compliant operators generally stay current with any revisions to the Guidebook and align their screening and eviction practices with the incorporated federal rule at 24 CFR Part 5 et al. (Docket No. FR-4495-F-02), which addresses drug abuse and other criminal activity. Operators typically maintain documentation showing that their policies reflect the most current version of both the Guidebook and any amendments to the incorporated federal standards.

For Tenants

Tenants living in Covered Units in Oklahoma should know that § 330:70-1-7 requires that both the Performance Based Contract Administrator Guidebook and the federal rule on screening and eviction for drug abuse and other criminal activity (24 CFR Part 5 et al., Docket No. FR-4495-F-02) govern how the program is administered. This means that any screening or eviction action taken against a tenant must conform to those incorporated standards, and a failure to follow them may be relevant in a dispute. Tenants who believe these standards have not been followed may consider contacting a local tenant-rights organization, reaching out to the Performance Based Contract Administrator, or filing a complaint with the U.S. Department of Housing and Urban Development for guidance on available options.
