Oklahoma Administrative Code § 330:36-1-9 establishes three interconnected obligations for Tax Credit Allocation (TCA) recipients in Oklahoma. First, they must sign a written Regulatory Agreement with the Oklahoma Housing Finance Agency (OHFA), which governs how their developments are operated. Second, OHFA makes a Compliance Manual available to owners, either on request or through its website. Third, all parties involved in a development—including owners, development teams, and affiliates—must follow applicable federal, state, and local laws, and are prohibited from discriminating against residents or applicants on the basis of characteristics such as race, religion, sex, disability, or familial status.
Plain English — not legal advice.
Under § 330:36-1-9, operators of OHFA-funded developments are generally expected to execute a Regulatory Agreement before placing a development in service and to keep its terms throughout the compliance period. Compliant operators typically obtain and follow the OHFA Compliance Manual—available at www.ohfa.org—and ensure that leasing, occupancy, and employment practices at the development conform to federal fair housing requirements, the Oklahoma Landlord Tenant Act, and civil rights statutes including Titles VI, VII, and VIII of the Civil Rights Act. Owners should also ensure that all affiliates and development team members are aware of these obligations, since § 330:36-1-9 extends compliance duties beyond the owner alone.

Section 330:36-1-9 of the Oklahoma Administrative Code provides that residents and applicants at OHFA-funded developments have the right to be free from discrimination based on race, creed, religion, national origin, ethnic background, age, sex, familial status, or disability in leasing and occupancy. If a tenant believes these protections have been violated, general enforcement paths include filing a complaint with OHFA, contacting the U.S. Department of Housing and Urban Development, or reaching out to a local tenant-rights organization for guidance on available options. Consulting a tenant-rights organization can help clarify which avenue—whether a fair housing complaint, a civil rights claim, or another remedy—may be appropriate given the circumstances.
