47-16-07. Leases - Notice by landlord to change terms - When effective.
In all leases of land or tenements, or of any interest therein, from month to month, the
landlord may change the terms of the lease to take effect at the expiration of the month upon
giving notice in writing at least thirty days before the expiration of the month. The notice, when
served upon the tenant, shall operate and be effectual to create and establish as a part of the
lease the terms, rent, and conditions specified in the notice, if the tenant shall continue to hold
the premises after the expiration of the month. For the purpose of this section, notice may be
served in any reasonable manner which actually informs the tenant of the changes in the terms
of the lease.Under North Dakota law, specifically N.D.C.C. § 47-16-07, a landlord renting on a month-to-month basis has the legal authority to alter the terms of that tenancy — including rent and other conditions — by providing written notice at least 30 days before the end of the current month. If the tenant remains in the property after that month expires, the new terms stated in the notice automatically become part of the lease. The notice must be delivered in any reasonable manner that actually brings the changes to the tenant's attention.
Plain English — not legal advice.
Under N.D.C.C. § 47-16-07, operators of month-to-month tenancies who wish to modify lease terms — such as adjusting rent or updating conditions — generally provide written notice to the tenant at least 30 days before the end of the month in which the change is to take effect. Compliant landlords use a delivery method that can be shown to have actually informed the tenant, such as personal delivery, certified mail, or another verifiable means. Keeping documentation of how and when notice was served helps establish that the new terms were properly incorporated into the tenancy.

N.D.C.C. § 47-16-07 gives month-to-month tenants an important protection: a landlord's proposed changes to lease terms — including rent increases — do not take effect unless written notice is received at least 30 days before the end of the month. If a tenant believes proper notice was not given, that procedural gap may be relevant to whether the new terms are enforceable. Tenants who have questions about whether a notice meets the legal standard may wish to consult a tenant-rights organization or legal aid provider familiar with North Dakota landlord-tenant law.
