Mobile home security deposit.
Operative Text
23-10-14. Mobile home security deposit.
The amount of a security deposit may not be modified after the initial lease agreement
between a mobile home park owner and a tenant has been executed by both parties.Under N.D.C.C. § 23-10-14, once a mobile home park owner and a tenant have both signed an initial lease agreement, the security deposit amount is fixed and cannot be changed by either party. This rule applies specifically to mobile home park tenancies in North Dakota. Any attempt to alter the security deposit amount after that mutual execution is not permitted under this provision.
Plain English — not legal advice.
Under N.D.C.C. § 23-10-14, compliant mobile home park operators set the security deposit amount before or at the time the initial lease is signed, understanding that the figure becomes locked in once both parties have executed the agreement. Operators generally review their deposit amounts carefully before presenting a lease, since no upward adjustment is available after execution. Lease renewal or renegotiation practices should account for this restriction when structuring agreements with new or existing tenants.

N.D.C.C. § 23-10-14 gives mobile home park tenants a clear protection: once both you and the park owner have signed the initial lease, the security deposit amount cannot be increased. If a park owner attempts to raise the deposit after that point, tenants may have grounds to raise this statutory provision as a defense or to file a complaint with the appropriate North Dakota state authority. Tenant-rights organizations in North Dakota can help residents understand how this protection applies to their situation and what general options may be available.
