N.D.C.C. §§ 23-10-01 through 23-10-14 § 23-10-06.1
License renewal.
Operative Text
23-10-06.1. License renewal.
1. A license issued under this chapter expires on December thirty-first of each year.
2. A license may be renewed by December thirty-first by submitting a renewal
application, a renewal fee established rule, provided the licensee is in compliance with
this chapter and any rules established by the department.
3. If the renewal application and renewal fee are not received by December thirty-first,
the license expires and the licensee may not operate.
4. Within sixty days after December thirty-first, an expired license may be renewed by
submitting the renewal application, renewal fee, and a late fee. The late fee is equal to
fifty percent of the license fee.
5. If the renewal application, renewal fee, and late fee are not received within sixty days
after December thirty-first, the department may not renew the license, and the
applicant shall apply and meet the requirements for licensure to be granted a license.
6. The department may extend the renewal deadline for applications providing proof of
hardship rendering the applicant unable to meet the deadline.
7. The department may not renew a license if the mobile home park, recreational vehicle
park, or campground is not actively conducting business at the site, and the applicant
shall apply and meet the requirements for licensure to be granted a license.Under N.D.C.C. § 23-10-06.1, licenses for mobile home parks, recreational vehicle parks, and campgrounds in North Dakota expire on December 31 each year and must be actively renewed to remain valid. A timely renewal requires a completed application and fee by that date; missing the deadline triggers a 60-day grace period during which a late fee equal to 50% of the license fee applies. If neither the timely nor the late renewal is completed, the operator must start the full licensure process over, and the department retains authority to deny renewal if the facility is not actively conducting business.
Plain English — not legal advice.
Operators of mobile home parks, recreational vehicle parks, and campgrounds subject to N.D.C.C. § 23-10-06.1 generally submit their renewal application and fee before December 31 each year to avoid a lapse in licensure. Compliant operators track the 60-day grace window carefully, since operating on an expired license is not permitted and missing that secondary deadline requires reapplying from scratch with full licensure requirements. Operators who anticipate difficulty meeting the deadline may document a qualifying hardship and request a departmental extension before the deadline passes.

Residents of mobile home parks and similar facilities have an interest in knowing that § 23-10-06.1 requires their park to hold a current, valid license to legally operate. If a park appears to be operating without a valid license—for example, after a lapsed renewal—tenants may contact the relevant North Dakota state department that oversees these licenses to inquire about compliance status. Tenant-rights organizations familiar with North Dakota housing law can help residents understand what options may be available when a facility's licensing status is in question.
