Gifts and grants - Fair housing fund - Continuing appropriation.
Operative Text
14-02.5-17. Gifts and grants - Fair housing fund - Continuing appropriation.
The department may accept grants from the federal government for administering this
chapter. Grants received must be deposited to the credit of the fair housing fund in the state
treasury. Moneys deposited to the credit of the fund are appropriated to the department on a
continuing basis for the purposes of administering this chapter.Section 14-02.5-17 of North Dakota's fair housing law establishes a mechanism by which the state department responsible for fair housing can receive federal grant money and use it to fund its operations. Any federal grants accepted must be placed into a dedicated "fair housing fund" held in the state treasury, and those funds are automatically made available to the department on an ongoing basis without requiring separate legislative appropriations each budget cycle. This provision is essentially a financial housekeeping rule that keeps the department's fair housing enforcement activities funded through federal support.

Under N.D.C.C. § 14-02.5-17, the state department administering North Dakota's fair housing chapter is authorized to receive and deploy federal grant funding for its oversight activities. Landlords and property managers operating in North Dakota should be aware that this funding mechanism helps sustain the department's capacity to investigate complaints and enforce fair housing requirements under the broader chapter. Compliant operators generally maintain their practices in accordance with the full chapter, knowing that the department has a dedicated, continuously appropriated fund supporting its administrative functions.

Section 14-02.5-17 ensures that the North Dakota department responsible for fair housing has a dedicated fund, supported by federal grants, to carry out its duties under the fair housing chapter on an ongoing basis. This means the agency's ability to receive and act on fair housing complaints is backed by a stable funding structure rather than being subject to year-to-year budget gaps. Tenants who believe their fair housing rights have been violated may consider reaching out to the department or a local tenant-rights organization to learn about available complaint processes under this chapter.
