Residential real estate-related transaction.
Operative Text
14-02.5-07. Residential real estate-related transaction.
A person whose business includes engaging in residential real estate-related transactions
may not discriminate against an individual in making a real estate-related transaction available
or in the terms or conditions of a real estate-related transaction because of race, color, religion,
sex, disability, age, familial status, national origin, or status with respect to marriage or public
assistance. A residential real estate-related transaction is the selling, brokering, or appraising of
residential real property or the making or purchasing of loans or the provision of other financial
assistance to purchase, construct, improve, repair, maintain a dwelling, or to secure residential
real estate. Nothing in this section prohibits a person engaged in the business of furnishing
appraisals of real property to take into consideration factors other than race, color, religion, sex,
disability, age, familial status, national origin, or status with respect to marriage.North Dakota Century Code § 14-02.5-07 prohibits businesses involved in residential real estate transactions from treating individuals differently based on protected characteristics such as race, color, religion, sex, disability, age, familial status, national origin, or marital and public-assistance status. This applies broadly to the sale, brokerage, and appraisal of residential property, as well as to the making or purchasing of loans and other financial assistance tied to residential real estate. Appraisers, however, retain the ability to consider factors unrelated to those protected characteristics when valuing property.
Plain English — not legal advice.
Operators involved in residential real estate transactions—including selling, financing, or arranging appraisals—are expected under § 14-02.5-07 to apply consistent standards regardless of a prospective buyer's or borrower's race, color, religion, sex, disability, age, familial status, national origin, or marital and public-assistance status. Compliant businesses typically document their transaction criteria, train staff on fair-lending and fair-housing standards, and review policies to ensure no protected characteristic influences the availability or terms of a transaction. Appraisal professionals may still apply legitimate, non-protected valuation factors as expressly recognized by this section.
