Plain English

Under 13 N.C.A.C. 16 .0402, when someone violates the provisions of this Chapter or G.S. 95, Article 19, the state is authorized to issue citations and impose penalties following the procedures set out in G.S. 95-137 and G.S. 95-138(a). This rule ties enforcement authority back to G.S. 95-227, establishing the legal basis for formal citation and penalty actions. The provision does not itself set specific dollar amounts but instead directs enforcement to the penalty framework already established in North Carolina's occupational safety statutes.

Compliant operators generally maintain records, conduct regular inspections of their properties, and promptly correct any identified deficiencies to avoid triggering the citation process described in G.S. 95-137 and G.S. 95-138(a). Familiarity with the underlying statutory penalty framework helps operators understand the potential consequences of non-compliance.
