N.C. Gen. Stat. § § 130A-453.10
Standards to ensure elimination of hazards; consumer information.
Operative Text
(a) Standards. - The Commission shall establish standards to ensure that inspections, risk assessments, and abatements performed under this Article result in the elimination of lead-based paint hazards. An inspection, risk assessment, or abatement performed under this Article must be performed in accordance with these standards. (b) Information. - The Department shall prepare a fact sheet on abatement for distribution to consumers. The sheet shall list the various measures for abatement of a child-occupied facility or target housing and give the relative cost of each measure. A person who is certified under this Article shall give a copy of the sheet to a person for whom the certified person performs an abatement. (1997-523, s. 1.)
Under N.C. Gen. Stat. § 130A-453.01 et seq. § 130A-453.10, North Carolina's Commission is required to set standards ensuring that lead-based paint inspections, risk assessments, and abatements actually eliminate hazards rather than merely address them superficially. Separately, the Department must produce a consumer fact sheet describing the range of abatement measures available for child-occupied facilities and target housing, along with the relative cost of each. Any certified professional who performs an abatement is required to hand that fact sheet directly to the person who hired them.

Property owners and managers who hire certified abatement professionals should be aware that, under N.C. Gen. Stat. § 130A-453.01 et seq. § 130A-453.10, all inspection, risk assessment, and abatement work must conform to the Commission's established standards for hazard elimination. Compliant operators typically verify that the certified contractor they engage is following those standards and is providing the state-prepared consumer fact sheet at the time of abatement. Keeping a copy of that fact sheet in property records can help document that the work was carried out in accordance with the Article's requirements.

N.C. Gen. Stat. § 130A-453.01 et seq. § 130A-453.10 gives tenants—particularly those in child-occupied facilities or target housing—the right to receive a state-prepared fact sheet whenever a certified professional performs a lead-based paint abatement on the property. This sheet describes the different abatement methods and their relative costs, helping residents understand what work is being done and why. Tenants who did not receive this fact sheet, or who have questions about whether abatement work met the Commission's standards, may consider contacting the North Carolina Department of Health and Human Services or a local tenant-rights organization for guidance on available options.
