Conflicts; applicability of law.
Operative Text
47-8-52. Conflicts; applicability of law.
Unless a provision of the Mobile Home Park Act [Chapter 47, Article 10 NMSA 1978]
directly conflicts with the provisions of the Uniform Owner-Resident Relations Act, the
provisions of the Uniform Owner-Resident Relations Act shall apply to mobile home
park owners and residents.
History: Laws 1989, ch. 253, § 3.
ARTICLE 8A
Rent Control ProhibitionSection 47-8-52 of New Mexico's Uniform Owner-Resident Relations Act establishes a default rule for mobile home park situations: the Uniform Owner-Resident Relations Act governs the relationship between park owners and residents unless a specific provision of the Mobile Home Park Act (Chapter 47, Article 10 NMSA 1978) directly conflicts with it. When a genuine conflict exists between the two statutes, the Mobile Home Park Act's conflicting provision takes precedence. This creates a layered framework where both laws can apply simultaneously, with the more specific Mobile Home Park Act carving out exceptions to the general Act.
Plain English — not legal advice.
Operators of mobile home parks in New Mexico should be aware that under § 47-8-52, the Uniform Owner-Resident Relations Act serves as the baseline legal framework governing their relationships with residents. Compliant operators generally familiarize themselves with both the Uniform Owner-Resident Relations Act and the Mobile Home Park Act (Chapter 47, Article 10 NMSA 1978) to identify any areas where the two statutes may directly conflict, since those conflicts determine which set of rules applies. Staying current with both bodies of law helps ensure that park management practices align with whichever statute properly governs a given situation.

Residents of mobile home parks in New Mexico have protections drawn from two overlapping bodies of law, as established by § 47-8-52. The Uniform Owner-Resident Relations Act generally applies to the owner-resident relationship, but where the Mobile Home Park Act (Chapter 47, Article 10 NMSA 1978) directly conflicts with it, the Mobile Home Park Act controls. Tenants who believe their rights under either statute have been violated may consider consulting a tenant-rights organization or legal aid provider familiar with New Mexico housing law to understand which set of protections applies to their circumstances.
