History: 1953 Comp., § 70-7-51, enacted by Laws 1975, ch. 38, § 51.Section 47-8-51 of New Mexico's Uniform Owner-Resident Relations Act establishes when the Act's protections and requirements take effect. The Act applies to rental agreements that were entered into, extended, or renewed after the law's effective date. Agreements that were already in place before that date, and any conditions tied to those pre-existing agreements, are not governed by the Act's provisions.
Plain English — not legal advice.
Under NMSA 47-8-51, compliant property owners and managers generally identify whether each rental agreement was created, extended, or renewed after the Uniform Owner-Resident Relations Act's effective date to determine which obligations apply. For agreements that predate the Act and have not been renewed or extended since, the Act's requirements do not automatically override the original terms. Operators typically maintain clear records of agreement dates to distinguish which tenancies fall under the Act's coverage.

Section 47-8-51 of the Uniform Owner-Resident Relations Act determines whether the Act's tenant protections apply to a given rental arrangement. If a rental agreement was signed, renewed, or extended after the Act's effective date, the full set of rights and remedies under the Act generally applies to that tenancy. Tenants who are uncertain whether their agreement falls within the Act's scope may find it useful to consult a tenant-rights organization or legal aid provider familiar with New Mexico housing law.
