Plain English

Under NMSA 47-10-21, a mobile home park landlord who provides utility services to residents is permitted to charge an administrative fee to help cover the costs of managing those services. That fee must be clearly and accurately stated in writing within the rental agreement, as required by the disclosure provisions of Section 47-10-14. If the landlord later raises the administrative fee, residents must receive written notice of the increase at least sixty days before it takes effect.

For Property Managers

Operators subject to NMSA 47-10-21 who provide utility services to residents generally ensure that any administrative fee is documented in plain, accurate language within the rental agreement, consistent with the disclosure requirements of Section 47-10-14. When a fee increase is planned, compliant operators provide written notice to each affected resident no fewer than sixty days before the new amount goes into effect. Maintaining clear records of both the original fee disclosure and any subsequent increase notices supports ongoing compliance with this provision.

For Tenants

NMSA 47-10-21 gives mobile home park residents the right to receive a written disclosure of any utility-service administrative fee before or at the time of signing a rental agreement. If a landlord intends to raise that fee, residents are entitled to at least sixty days' written advance notice under this same provision. Residents who believe a fee was not properly disclosed or that adequate notice of an increase was not given may consider raising the issue with a local tenant-rights organization or exploring whether a complaint can be filed under the Mobile Home Park Act.
