History: 1978 Comp., § 47-10-19, enacted by Laws 1993, ch. 147, § 5.Under NMSA § 47-10-19, mobile home park landlords are required to give residents written notice of any rent increase at least sixty days before the increase takes effect. Separately, when a resident or prospective resident submits a written request, the landlord must provide a written schedule showing the current range of rental rates in the park, including the date that schedule was prepared. The law applies to mobile home parks in New Mexico and establishes both a timing requirement and a transparency requirement around rental pricing.
Plain English — not legal advice.
Operators of mobile home parks in New Mexico subject to NMSA § 47-10-19 generally maintain a practice of delivering written rent-increase notices no fewer than sixty days before the new rate takes effect, keeping documentation of when each notice was delivered. Compliant operators also keep an up-to-date written schedule of the range of rental rates in the park, ready to be provided in writing to any resident or prospective resident who submits a written request. The schedule should display the date it was prepared on its face, so recipients can verify its currency.

NMSA § 47-10-19 gives mobile home park residents the right to receive written notice of a rent increase at least sixty days before it is implemented, and the right to request a written schedule of the park's current rental rate ranges at any time. If a landlord fails to provide the required sixty-day written notice, that failure may be relevant to whether the increase was properly implemented under New Mexico law. Residents who believe their landlord has not complied with § 47-10-19 may wish to contact a tenant-rights organization or the New Mexico Attorney General's consumer protection office to understand available options.
