Operative Text
47-10-16. New developments and parks; rental of sites to dealers authorized.
A. The management of a new mobile park or manufactured housing community
development may require as a condition of leasing a mobile home site or manufactured
home site for the first time such site is offered for lease that the prospective lessee has
purchased a mobile home or manufactured home from a particular seller or from any
one of a particular group of sellers.
B. A licensed mobile home dealer or a manufactured home dealer may, by contract
with the management of a new mobile home park or manufactured housing community
development, be granted the exclusive right to first-time rental of one or more mobile
home sites or manufactured home sites.
History: Laws 1983, ch. 122, § 16.Under NMSA 47-10-16, when a mobile home park or manufactured housing community is newly developed, its management is permitted to tie the first-time lease of a site to a requirement that the incoming resident purchase their home from a specific seller or a designated group of sellers. Additionally, the management of such a new development may grant a licensed mobile home or manufactured home dealer an exclusive contractual right to handle the initial rental of one or more sites. This rule applies only to the first-time leasing of sites in new developments, not to subsequent re-rentals or existing parks.
Plain English — not legal advice.
Operators of new mobile home parks or manufactured housing community developments may, under NMSA 47-10-16, structure their initial site-leasing program to require that first-time lessees purchase their homes from a designated seller or group of sellers. Management may also enter into a written contract with a licensed dealer granting that dealer exclusive rights over the first-time rental of specific sites. Compliant operators typically ensure that any such arrangement is limited to the initial lease offering and that any dealer involved holds the appropriate license under New Mexico law.

Under NMSA 47-10-16, prospective residents of a newly developed mobile home park or manufactured housing community should be aware that management is legally permitted to condition a first-time site lease on purchasing a home from a particular seller or group of sellers. This purchase-source requirement applies only to the initial leasing of sites in new developments, so tenants in existing parks or those renewing leases are generally not subject to this condition. Tenants who believe a seller-purchase requirement is being applied outside the scope of a new development's first-time leasing may wish to consult a tenant-rights organization or review the New Mexico Mobile Home Park Act for further context.
