N.M. Stat. Ann. § 47-10-13
Certain types of landlord-seller agreements prohibited.
Operative Text
47-10-13. Certain types of landlord-seller agreements prohibited. A seller of mobile homes shall not pay or offer cash or other consideration other than rent to the owner of a mobile home park or his agent for the purpose of reserving spaces or otherwise inducing acceptance of one or more mobile homes in a mobile home park. History: Laws 1983, ch. 122, § 13.
Section 47-10-13 of the Mobile Home Park Act prohibits a mobile home seller from paying or offering cash or any other form of consideration—beyond ordinary rent—to a park owner or the owner's agent in order to secure space reservations or gain acceptance of mobile homes in a park. The rule targets side arrangements between sellers and park operators that could distort fair access to available spaces. It applies regardless of whether the inducement is framed as a gift, fee, or any other benefit.
Plain English — not legal advice.
Under NMSA § 47-10-13, compliant park owners and their agents decline any payment, gift, or other consideration offered by a mobile home seller that goes beyond standard rent. Operators generally document their space-allocation processes to demonstrate that placements are made on neutral terms rather than through seller-funded inducements. Maintaining clear, consistent written policies for space reservations helps show that no prohibited arrangements have been entered into.

NMSA § 47-10-13 is designed to keep the process of gaining access to mobile home park spaces free from behind-the-scenes financial arrangements between sellers and park owners. If a tenant suspects that a seller paid improper consideration to secure their placement—or to block others—that concern can be raised with New Mexico state authorities or a tenant-rights organization familiar with mobile home park law. Awareness of this provision can also be relevant when evaluating the fairness of how spaces in a park are allocated or offered.
