N.J. Stat. Ann. § 52:27D-280 et seq. § 52:27D-283
Alternative sources of rental assistance; priority of housing to assistance applicants
Operative Text
No person shall continue to receive temporary rental assistance if alternative sources of rental subsidy, including, without limitation, rental assistance under the federal section 8 programs and public housing, become available. Every local housing authority, and every limited dividend or nonprofit housing corporation or association which owns or controls a subsidized housing project, or subsidized units within a housing project and which receives local property tax abatement pursuant to any law of this State, shall give priority to applications by persons receiving temporary rental assistance, subject to the requirements of other applicable federal and State statutes and regulations. L.1984, c. 180, s. 5, eff. Nov. 9, 1984.
Under N.J.S.A. 52:27D-283, temporary rental assistance is designed as a bridge benefit — once a recipient becomes eligible for an alternative rental subsidy such as federal Section 8 or public housing, continued receipt of the temporary assistance is no longer permitted. At the same time, the provision creates a corresponding obligation on the other side: local housing authorities and certain tax-abated nonprofit or limited-dividend housing entities must move applicants who are currently receiving temporary rental assistance to the front of the line when processing applications, within the bounds of other applicable federal and state rules. The rule reflects a policy of transitioning households from short-term aid into longer-term, stable housing programs as quickly as those programs become accessible.
Plain English — not legal advice.
Owners and managers of subsidized housing projects or subsidized units that benefit from a local property tax abatement under New Jersey law should be aware that N.J.S.A. 52:27D-283 places an affirmative priority obligation on their organizations when processing rental applications. Compliant operators generally maintain application procedures that identify and elevate applicants who are current recipients of temporary rental assistance, while still adhering to any overlapping federal or state program requirements that govern tenant selection. Keeping clear documentation of how priority is applied in the admissions process helps demonstrate conformance with this provision.

N.J.S.A. 52:27D-283 establishes that households receiving temporary rental assistance have a right to priority consideration when applying to local housing authorities or to tax-abated nonprofit and limited-dividend housing developments in New Jersey. If a tenant becomes eligible for a longer-term subsidy such as Section 8 or public housing, the temporary assistance is expected to end, making it important to understand how that transition works. Tenants who believe their priority status has been overlooked may wish to contact the relevant housing authority directly, reach out to a local tenant-rights organization, or consult with a legal aid office familiar with New Jersey housing law.
