N.J. Stat. Ann. § 46:8C-1 et seq. § 46:8C-12.3
Assignment of rights to a municipality, housing authority, State agency, or nonprofit
Operative Text
6. A resident homeowner group that has rights pursuant to P.L.1991, c.483 (C.46:8C-10 et seq.) may, at its election by the consent of 51 percent of resident homeowners, assign such rights to the municipality in which the resident homeowner group is located, a housing authority located in the municipality, an agency of the State, or a nonprofit corporation or cooperative, for the purpose of continuing the use of the property as a manufactured home community. Upon assignment, the assignee shall be entitled to exercise the rights that P.L.1991, c.483 (C.46:8C-10 et seq.) grants to the assignor-resident homeowner group. L.2025, c.362, s.6.
Under N.J.S.A. 46:8C-12.3, a resident homeowner group in a manufactured home community has the option to transfer—or "assign"—its statutory rights to a municipality, local housing authority, state agency, or qualifying nonprofit or cooperative. This transfer requires the approval of at least 51 percent of the resident homeowners in the group. Once the assignment is completed, the receiving organization steps into the shoes of the resident homeowner group and may exercise all the same rights under the law that the group originally held, with the goal of preserving the property as a manufactured home community.
Plain English — not legal advice.
As the owner or operator of a manufactured home community in New Jersey, N.J.S.A. 46:8C-12.3 means that the resident homeowner group on your property may vote—by a 51 percent majority—to transfer its statutory rights to a governmental or nonprofit entity. Compliant operators generally stay informed about whether such an assignment has occurred, since the assignee entity would then hold the same rights previously held by the resident group. Maintaining clear communication channels and accurate records of who holds these rights helps operators respond appropriately to any notices or exercises of those rights.

If you are a resident homeowner in a manufactured home community, N.J.S.A. 46:8C-12.3 gives your group a collective option: by a vote of 51 percent of resident homeowners, the group can transfer its statutory rights to a municipality, housing authority, state agency, or nonprofit to help preserve the community. Understanding whether such an assignment has taken place—and who now holds those rights—can be important context for how those rights are exercised on your community's behalf. Tenant-rights organizations and legal aid services familiar with New Jersey manufactured housing law can help explain what this provision means for residents in a given community.
