N.J. Stat. Ann. § 46:8-1 et seq. § 46:8-29.1
Tenants advised of list
Operative Text
2. Within 30 days following notification by the municipal clerk pursuant to section 1 of P.L.2017, c.266 (C.40:48-2.67), and thereafter, at the time of creation of a tenancy, a landlord shall advise each tenant that the clerk of the municipality maintains a list containing the names and addresses of municipal residents who identify themselves as being in need of special assistance in the event of an emergency, and who request that this information be maintained on their behalf, for public safety purposes. The landlord shall provide each tenant with a copy of the notice including information as to how a tenant may be added to the list. L.2017, c.266, s.2.
Under N.J.S.A. 46:8-1 et seq. § 46:8-29.1, New Jersey landlords are required to inform tenants about a municipal list maintained by the local clerk that tracks residents who self-identify as needing special assistance during emergencies. This notification must occur within 30 days after the landlord receives notice from the municipal clerk, and again each time a new tenancy is created. The landlord must also provide a written copy of the notice that explains how a tenant can request to be added to the list.

Compliant operators under N.J.S.A. 46:8-1 et seq. § 46:8-29.1 generally track the date they receive notification from the municipal clerk and ensure the required tenant advisory goes out within the 30-day window. At the start of each new tenancy, landlords typically include the written notice—along with instructions on how tenants can be added to the emergency assistance list—as part of their standard move-in documentation. Maintaining records of when and to whom these notices were delivered is a common practice among property managers seeking to demonstrate compliance.

N.J.S.A. 46:8-1 et seq. § 46:8-29.1 gives tenants the right to receive written notice about a municipal emergency assistance list maintained by the local clerk, including information on how to request placement on that list. If a landlord fails to provide this notice at the start of a tenancy or within the required timeframe, tenants may wish to contact their local municipal clerk's office to learn about the list directly and to understand what remedies may be available. Tenant-rights organizations in New Jersey can also help residents understand how this provision applies and what options exist if the notice was not provided.
