N.J. Stat. Ann. § 2A:18-51 et seq. § 2A:18-61.25
Protected tenancy status; conversion of dwelling unit of eligible senior citizen or disabled tenant
Operative Text
Each eligible senior citizen tenant or disabled tenant shall be granted a protected tenancy status with respect to his dwelling unit whenever the building or structure in which that unit is located shall be converted. The protected tenancy status shall be granted upon proper application and qualification pursuant to the provisions of this amendatory and supplementary act. L.1981, c. 226, s. 4, eff. July 27, 1981.
Under N.J.S.A. 2A:18-61.25 (part of the N.J.S.A. 2A:18-51 et seq. framework), when a residential building undergoes a conversion—such as a condominium or cooperative conversion—eligible senior citizen and disabled tenants are entitled to receive protected tenancy status for their dwelling units. This protection is not automatic; it is granted after the tenant submits a proper application and meets the qualification requirements set out in the act. The provision effectively shields qualifying tenants from displacement that would otherwise result from the conversion process.
Plain English — not legal advice.
Property owners and managers overseeing a building conversion covered by N.J.S.A. 2A:18-51 et seq. § 2A:18-61.25 generally ensure that eligible senior citizen and disabled tenants are informed of their right to apply for protected tenancy status before and during the conversion process. Compliant operators typically maintain records of application submissions and qualification determinations, and they do not treat a qualifying tenant's unit as freely available for conversion until the protected tenancy status question has been properly resolved. Familiarity with the full application and qualification procedures outlined in the act is a standard part of managing a conversion under New Jersey law.

N.J.S.A. 2A:18-51 et seq. § 2A:18-61.25 establishes that eligible senior citizens and disabled tenants have the right to apply for protected tenancy status when their building is being converted, which can provide significant security against displacement. Tenants who believe they qualify should be aware that the protection is tied to a formal application and qualification process, so understanding the procedural requirements of the act is important. Tenant-rights organizations and legal aid services in New Jersey can help individuals understand whether they meet the eligibility criteria and what steps are generally involved in asserting this protection.
