Under N.J.A.C. § 5:28A-3.1, owners of covered dwellings are required to obtain and share valid lead-safe certifications with tenants and municipalities at key moments — including tenant turnover, cyclical inspections, and real estate transactions. The certification must be attached to the tenant's lease as an exhibit, and records of certifications (including tenant names when inspections occur during tenancy) must be kept on file. Prospective buyers must also receive copies of the certification and the accompanying guidance document, 'Lead-Based Paint in Rental Dwellings,' during any sale or closing.
Plain English — not legal advice.
Operators of dwellings covered by N.J.A.C. § 5:28A-3.1 generally maintain an up-to-date lead-safe certification and distribute it at each tenant turnover — attaching a copy directly to the lease agreement. For multiple dwellings, compliant operators bring both the certification and evidence of the most recent tenant turnover to any cyclical inspection conducted under the Hotel and Multiple Dwelling Law. Owners also keep organized records of certifications (noting tenant names when applicable), promptly notify the municipality of all tenant turnover activity, and provide the certification along with the 'Lead-Based Paint in Rental Dwellings' guidance document to prospective buyers during any real estate transaction or closing.

Under N.J.A.C. § 5:28A-3.1, tenants in covered dwellings have a right to receive a copy of a valid lead-safe certification at the time they move in, and that certification should appear as an attached exhibit to their lease. If a tenant does not receive this documentation at move-in, that absence may be relevant to any complaint or enforcement action involving lead-paint compliance. Tenants who believe their landlord has not met these obligations can contact their local municipality, reach out to the New Jersey Department of Community Affairs, or consult a tenant-rights organization for guidance on available options.
