Cal. Civ. Code § 5:11-4.4
Providing housing
Operative Text
(a) Whenever an individual is eligible for relocation payments and assistance, a displacing agency may, at its discretion, directly provide decent, safe and sanitary units, whether subsidized or not, that are not less desirable than the unit from which the displacee is displaced. In the event the displacee unreasonably rejects the housing so offered, the duty of the displacing agency to provide assistance is ended. (b) Any displacing agency that terminates assistance pursuant to (a) above shall notify the displacee in writing of its intention to terminate assistance and the reasons therefor and shall advise the displacee of his or her right of appeal in accordance with N.J.A.C. 5:11-9.2.
Under N.J.A.C. § 5:11-4.4, when a person is eligible for relocation assistance, the displacing agency has the option to directly offer replacement housing that meets decent, safe, and sanitary standards and is at least as desirable as the unit the person is leaving. If the displaced person turns down that housing offer without a reasonable basis, the agency's obligation to provide further assistance may end. Before terminating assistance, the agency must give written notice explaining the reason and informing the person of their right to appeal under N.J.A.C. 5:11-9.2.
Plain English — not legal advice.
Displacing agencies operating under N.J.A.C. § 5:11-4.4 that choose to offer direct housing should ensure any unit provided meets decent, safe, and sanitary standards and is comparable in desirability to the displaced person's prior unit. If a displacee declines the offered housing without reasonable justification, operators generally document that rejection carefully before moving to terminate assistance. Any termination of assistance requires a written notice to the displacee that states the reasons for termination and clearly identifies the appeal rights available under N.J.A.C. 5:11-9.2.

Under N.J.A.C. § 5:11-4.4, displaced individuals have the right to receive housing that is decent, safe, sanitary, and no less desirable than their prior home when a displacing agency opts to provide direct housing. If a displacing agency moves to end your relocation assistance, it is required to give you written notice explaining why and informing you of your right to appeal under N.J.A.C. 5:11-9.2. Displaced persons who believe their assistance was improperly terminated may explore the formal appeal process described in N.J.A.C. 5:11-9.2 or consult a tenant-rights organization for general guidance on their options.
