Cal. Civ. Code § 5:11-4.3
Assistance in obtaining housing
Operative Text
(a) Whenever an individual requires assistance in locating replacement housing the displacing agency shall: 1. Provide a list of decent, safe and sanitary replacement housing units that are available for sale or lease. 2. Assist in establishing the displaced individual's priority in subsidized housing and in applying therefor. 3. Provide information necessary for the displacee to obtain mortgage financing; and 4. Provide the name and address of other agencies that provide housing assistance to individuals.
Under N.J.A.C. § 5:11-4.3, when a government or agency action displaces an individual from their home, the displacing agency is required to actively help that person find new housing. This assistance includes supplying a list of available decent, safe, and sanitary units for sale or rent, helping the displaced person establish priority status for subsidized housing, providing mortgage financing information, and referring them to other agencies that offer housing assistance. The rule ensures that displacement does not leave individuals without a structured support system for finding replacement housing.
Plain English — not legal advice.
Property owners and managers involved in projects that trigger displacement under N.J.A.C. § 5:11-4.3 should be aware that the displacing agency — not the landlord — bears the primary obligation to assist displaced individuals. However, operators working alongside or under contract with a displacing agency are generally expected to cooperate in providing accurate information about available units and to facilitate referrals as required. Understanding the scope of these agency obligations helps property managers anticipate the relocation process and coordinate accordingly.

If you have been displaced by a government or agency action, N.J.A.C. § 5:11-4.3 entitles you to meaningful assistance from the displacing agency in finding replacement housing. This includes receiving a list of available units, help applying for subsidized housing priority, mortgage financing information, and referrals to other housing assistance organizations. Displaced individuals who believe they are not receiving the assistance this provision requires may consider contacting the displacing agency directly, reaching out to a local tenant-rights organization, or exploring complaint processes available through New Jersey housing authorities.
