Cal. Civ. Code § 5:11-4.2
Notification
Operative Text
Whenever a displacing agency determines that their activities shall cause a displacement of individuals or businesses that are eligible for relocation payments and assistance, the displacing agency shall notify those individuals and businesses, in writing, at the earliest possible date of the benefits and obligations of the Act and this chapter. Said notice shall be issued immediately upon the determination of the displacing agency that displacement shall occur. The notice shall contain the nature and types of payments and assistance available, the eligibility criteria, and a notice that the displacee should not vacate the property prior to being authorized to do so in order to remain eligible for payment and assistance and that they should continue to pay rent to the landlord, as provided by the law.
Under N.J.A.C. § 5:11-4.2, whenever a displacing agency determines that its activities will cause eligible individuals or businesses to be displaced, it must promptly provide written notice about the relocation benefits and obligations available under the Act. This notice must describe the types of payments and assistance offered, the eligibility criteria, and a clear warning that displaced persons should not vacate the property before being authorized to do so, as premature departure can affect eligibility. The provision ensures that affected parties receive timely, written information so they can make informed decisions about their relocation.

Under N.J.A.C. § 5:11-4.2, when a displacing agency's project affects a rental property, landlords should be aware that their tenants are entitled to receive formal written notification of relocation benefits at the earliest possible date. Compliant operators in displacement situations typically maintain open communication with the displacing agency to ensure tenants are properly informed and continue to receive rent payments as required by law. Landlords generally continue to accept rent from tenants who remain in the property until the displacing agency authorizes their departure, as the provision explicitly requires tenants to keep paying rent to remain eligible for assistance.

N.J.A.C. § 5:11-4.2 gives eligible displaced tenants the right to receive written notice from the displacing agency describing the relocation payments and assistance available to them, along with the eligibility criteria. Critically, this provision states that tenants should not vacate the property before being officially authorized to do so, as leaving early may jeopardize eligibility for relocation benefits. Tenants who believe they have not received proper notice, or who have questions about their rights under this provision, may consider contacting the displacing agency directly, reaching out to a local tenant-rights organization, or consulting with a housing attorney familiar with New Jersey relocation law.
