Cal. Civ. Code § 5:11-3.8
Payments to businesses
Operative Text
(a) An eligible business that is displaced from its place of operation and moves it personal property therefrom shall be entitled to receive payment for: 1. Actual reasonable moving expenses, as set forth in N.J.A.C. 5:11-3.9; actual reasonable direct loss of tangible personal property, as set forth in N.J.A.C. 5:11-3.10; actual reasonable expenses incurred in searching for a replacement business, as set forth in N.J.A.C. 5:11-3.11; and actual reasonable expenses for professional fees incurred in the renovation and lease, use or acquisition of the replacement site, as set forth in N.J.A.C. 5:11-3.13; or 2. Payment in lieu of moving and related expenses (paragraph 1 of this subsection) as set forth in N.J.A.C. 5:11-3.12.
Under N.J.A.C. § 5:11-3.8, when an eligible business is displaced from its place of operation, it becomes entitled to financial assistance to help cover the costs of relocation. The rule provides two broad payment paths: one covering actual, documented costs such as moving expenses, loss of tangible personal property, replacement-site search costs, and professional fees for renovation or lease of a new site; or alternatively, a fixed payment in lieu of those itemized expenses. Each path references companion sections of N.J.A.C. 5:11 that set out the specific eligibility and calculation rules for each category.

Property owners and public agencies overseeing displacement under N.J.A.C. § 5:11-3.8 generally ensure that eligible businesses are informed of both payment options before relocation occurs. Compliant operators typically document the displaced business's actual costs and maintain records sufficient to support reimbursement claims under the itemized path, or facilitate the fixed in-lieu payment calculation under N.J.A.C. 5:11-3.12. Providing clear written notice of available benefits and deadlines is a standard practice associated with compliance under this provision.

Businesses displaced from their place of operation may have a right to relocation payments under N.J.A.C. § 5:11-3.8, including reimbursement for moving costs, property loss, site-search expenses, and professional fees, or a lump-sum alternative. Displaced businesses can document their actual costs and request the appropriate payment from the displacing agency, referencing the specific companion sections of N.J.A.C. 5:11 that govern each category. Those who believe their entitlements under N.J.A.C. § 5:11-3.8 have not been honored may explore filing a complaint with the relevant agency or consulting a tenant-rights or business-relocation assistance organization for general guidance.
