Plain English

Under N.J.A.C. § 5:11-3.13, when a business is displaced—typically as a result of a government action such as eminent domain or a public project—the owner of that business may be eligible to receive reimbursement for certain professional fees incurred in connection with relocating. Covered expenses can include architectural plans required by local ordinance for adapting a new site, as well as legal services such as researching local rules and preparing documents for planning boards or construction officials. The provision uses non-limiting language, meaning these examples do not necessarily represent an exhaustive list of reimbursable professional services.

For Property Managers

Property owners or managers involved in displacement situations under N.J.A.C. § 5:11-3.13 should be aware that displaced business owners may have a right to claim reimbursement for professional fees as part of the relocation process. Operators administering or participating in projects that trigger business displacement generally document and track professional service costs—such as architect and legal fees—that are tied to the relocation. Maintaining clear records of which fees are directly connected to the displacement and the requirements of the new site helps support a complete and accurate claim under this provision.

For Tenants

If you operate a business that has been displaced due to a government-related action, N.J.A.C. § 5:11-3.13 establishes that you may be entitled to payment for professional fees, including architectural and legal services needed to set up at a new location. Displaced business owners can explore this entitlement by reviewing the relocation assistance process administered under New Jersey's hotel and multiple dwelling and relocation regulations, and by consulting with a tenant-rights or relocation-rights organization familiar with state displacement law. Raising this provision during the relocation assistance process—or as part of any dispute over the scope of reimbursable costs—is one avenue available to displaced business operators.
