Cal. Civ. Code § 5:11-3.11
Expenses for searching for a replacement location
Operative Text
(a) In addition to moving expenses and loss of personal property payments, a displaced business shall be reimbursed for the actual and reasonable expenses incurred in searching for a replacement location, not to exceed $ 1,000.00. (b) These expenses may include transportation costs within 50 miles, time spent in searching, not exceeding $ 15.00 per hour, and fees paid to a real estate agent for locating a site.
Under N.J.A.C. § 5:11-3.11, a business that has been displaced is entitled to reimbursement for the actual and reasonable costs it incurs while searching for a new location, on top of any moving-expense or personal-property-loss payments it may already receive. The total search-expense reimbursement is capped at $1,000. Eligible costs can include transportation within a 50-mile radius, time spent searching at up to $15 per hour, and real estate agent fees paid to find a replacement site.

Property owners and managers involved in projects that trigger displacement under N.J.A.C. § 5:11-3.11 should be aware that displaced businesses have a right to claim search-expense reimbursements separate from other relocation payments. Operators administering relocation assistance generally document and process these claims carefully, verifying that submitted costs—such as mileage, time logs, and agent invoices—are actual, reasonable, and within the statutory limits. Maintaining clear records of all reimbursement requests and approvals helps demonstrate compliance with the $1,000 cap and the other conditions set out in this provision.

Businesses displaced from a location may be entitled under N.J.A.C. § 5:11-3.11 to recover documented search costs—such as transportation, time spent looking for a new site, and real estate agent fees—up to a combined ceiling of $1,000. Keeping detailed records of every search-related expense, including mileage logs, time records, and receipts for agent fees, supports a reimbursement claim under this provision. Displaced businesses can explore their options by contacting the administering agency overseeing the relocation assistance program or by reaching out to a tenant-rights or small-business advocacy organization familiar with New Jersey relocation law.
