Cal. Civ. Code § 5:11-1.1
The Relocation Assistance Law of 1967 (P.L. 1967, c.79, N.J.S.A. 52:31B-1 et seq.), the Relocation Assistance Act (P.L. 1971, c.362, N.J.S.A. 20:4-1 et seq.) and the Eviction Law (P.L. 1974, c.49, N.J.S.A. 2A:18-61.1 et seq.) were passed by the legislature in order to establish and assure the uniform, fair and equitable treatment of persons displaced due to state and local programs of acquisition, code enforcement and voluntary rehabilitation of buildings. These regulations are promulgated so that the Department of Community Affairs may carry out the provisions of the Act.

N.J.A.C. § 5:11-1.1 introduces the regulatory framework that implements three New Jersey statutes — the Relocation Assistance Law of 1967, the Relocation Assistance Act of 1971, and the Eviction Law of 1974 — which together are designed to ensure fair and consistent treatment of people displaced by government acquisition, code enforcement, or voluntary building rehabilitation programs. The New Jersey Department of Community Affairs (DCA) is designated as the agency responsible for carrying out these protections. This section establishes the legal foundation and purpose of the broader set of rules that follow in N.J.A.C. § 5:11.

For Property Managers

Under N.J.A.C. § 5:11-1.1, property owners involved in projects connected to government acquisition, code enforcement, or voluntary rehabilitation programs operate within a framework overseen by the New Jersey Department of Community Affairs. Compliant operators generally familiarize themselves with the full scope of N.J.A.C. § 5:11 to understand what relocation obligations may be triggered by their participation in such programs. Awareness of the three underlying statutes — the Relocation Assistance Law of 1967, the Relocation Assistance Act of 1971, and the Eviction Law of 1974 — helps property managers anticipate their responsibilities when displacement of occupants is involved.

For Tenants

N.J.A.C. § 5:11-1.1 signals that tenants displaced by government-related acquisition, code enforcement actions, or voluntary building rehabilitation may have rights under New Jersey's relocation assistance laws, administered by the Department of Community Affairs. This introductory provision establishes that the rules in N.J.A.C. § 5:11 exist specifically to ensure fair and equitable treatment for displaced persons. Tenants who believe they may be affected by such displacement can review the full N.J.A.C. § 5:11 regulations, contact the New Jersey Department of Community Affairs, or reach out to a local tenant-rights organization to understand what protections may apply.
