Cal. Civ. Code § 5:10-28.1
Carbon monoxide alarms
Operative Text
(a) Carbon monoxide alarms shall be installed and maintained in full operating condition in the following locations: 1. Single station carbon monoxide alarms shall be installed and maintained in the immediate vicinity of the sleeping area in every guestroom or dwelling unit in buildings that contain a fuel-burning appliance or that have an attached garage. 2. As an alternative to the requirements at (a)1 above, carbon monoxide alarms may be installed, in accordance with the Uniform Construction Code, N.J.A.C. 5:23. A copy of the certificate of approval issued by the local construction code enforcing agency shall be provided to the Bureau at the time of installation, at or after the time of inspection, or at any other time, as proof of installation, in accordance with the Uniform Construction Code. Devices may be installed in locations, as specified in the Uniform Construction Code, N.J.A.C. 5:23, or the Uniform Fire Code, N.J.A.C. 5:70. (b) Carbon monoxide alarms shall be manufactured, listed and labeled in accordance with UL 2034 and shall be installed in accordance with the requirements of this subchapter and NFPA 720. Carbon monoxide alarms shall be battery operated, hard-wired or of the plug-in type. (c) At the request of a tenant of a multiple dwelling unit in which a person who is deaf or hearing-impaired resides, the owner shall provide and install a visual alarm type carbon monoxide detector for that unit.
N.J.A.C. § 5:10-28.1 requires that carbon monoxide alarms be installed and kept in working order in residential buildings that contain fuel-burning appliances or have attached garages, with alarms placed near sleeping areas. The alarms must meet UL 2034 standards and be installed per NFPA 720 guidelines, and may be battery-operated, hard-wired, or plug-in. When a deaf or hearing-impaired resident lives in a multiple dwelling unit, the rule requires the owner to provide and install a visual alarm upon that tenant's request.
Plain English — not legal advice.
Under N.J.A.C. § 5:10-28.1, compliant property operators ensure that carbon monoxide alarms meeting UL 2034 and NFPA 720 standards are installed near sleeping areas in every unit within buildings that have fuel-burning appliances or attached garages. Operators who choose the alternative installation path under the Uniform Construction Code (N.J.A.C. 5:23) retain a copy of the certificate of approval from the local construction code enforcing agency and provide it to the Bureau as required. When a tenant in a multiple dwelling unit notifies the owner that a deaf or hearing-impaired person resides there, the owner is responsible for supplying and installing a visual alarm carbon monoxide detector for that unit.

N.J.A.C. § 5:10-28.1 gives tenants in qualifying buildings the right to have functioning carbon monoxide alarms installed near sleeping areas, and tenants who are deaf or hearing-impaired—or who live with someone who is—have the right to request that the owner provide and install a visual alarm device. If an owner fails to install or maintain required alarms, tenants may raise this as a housing code violation through New Jersey's Bureau of Housing Inspection or a local code enforcement office. Tenant-rights organizations can help residents understand the complaint and inspection process available under this provision.
