N.H. Rev. Stat. Ann. § 540-B: § 540-B:3
Termination of Tenancy; Notice of Termination.
Operative Text
I. The owner or agent of the owner of a shared facility may terminate any tenancy without stating any reason. A written 30-day notice of termination shall be required. II. The owner or agent of the owner of a shared facility may terminate any tenancy for nonpayment of rent. A written 7-day notice of termination shall be required. III. The owner or agent of the owner of a shared facility may terminate any tenancy for damage to the premises, or behavior of the occupant or guest of any family member of the occupant which adversely affects the health or safety of the other occupants or the owner or the agent of the owner, or material breech of any rental agreement. A written 72-hour notice of termination shall be required. IV. The process for termination of tenancy of a shared facility described by paragraphs I-III shall apply in place of the eviction process detailed in RSA 540. Shared facilities governed by this chapter shall not be subject to the eviction process of RSA 540.
Under N.H. Rev. Stat. Ann. § 540-B:3, owners of shared-facility housing — where common areas such as kitchens or bathrooms are shared — may end a tenancy through one of three notice tracks: a 30-day written notice for any reason or no reason at all, a 7-day written notice for nonpayment of rent, and a 72-hour written notice for property damage, health-or-safety-threatening behavior, or a material breach of the rental agreement. Critically, this provision replaces the standard RSA 540 eviction process entirely for shared facilities; the two frameworks do not run in parallel. The notice type and timeline depend on the grounds the owner invokes.
Plain English — not legal advice.
Owners and managers of shared-facility properties in New Hampshire operate under a distinct termination framework established by § 540-B:3, separate from the general RSA 540 eviction process. Compliant operators issue written notices that match the correct statutory timeframe — 30 days for no-cause terminations, 7 days for nonpayment, and 72 hours for damage, safety-threatening conduct, or material lease breaches — and retain copies of all notices as documentation. Because § 540-B:3 explicitly displaces RSA 540 for shared facilities, operators generally confirm which chapter governs their property type before initiating any termination proceeding.

Tenants living in shared-facility housing — where spaces like kitchens or bathrooms are shared with others — have specific protections tied to notice requirements under § 540-B:3. Depending on the stated reason for termination, a tenant is entitled to receive written notice of at least 72 hours, 7 days, or 30 days before a tenancy can be ended, and a notice that does not meet these requirements may be legally defective. Tenants who believe a termination notice fails to comply with § 540-B:3 may wish to consult a tenant-rights organization or legal aid provider to understand the options available to them, including raising the deficiency as a defense in any subsequent proceeding.
