N.H. Rev. Stat. Ann. § 540: § 540:29
Any provisions of federal law relating to rental units owned, operated or subsidized by the federal government which are inconsistent with or contrary to the provisions of this chapter shall supersede the provisions of this chapter. Where not inconsistent, the provisions of federal law shall apply in conjunction with the provisions of this chapter.

Under N.H. Rev. Stat. Ann. § 540:29, when federal law governing federally owned, operated, or subsidized rental housing conflicts with New Hampshire's Chapter 540 eviction and landlord-tenant rules, federal law takes precedence. Where federal and state rules do not conflict, both sets of rules apply together to the same rental unit. This provision establishes a clear hierarchy so that neither landlords nor tenants in federally connected housing are left guessing which legal framework governs a given situation.

For Property Managers

Operators of federally owned, operated, or subsidized rental units subject to § 540:29 generally maintain compliance with both federal program requirements and New Hampshire Chapter 540 rules simultaneously, except where the two conflict. In cases of genuine conflict, compliant operators follow the federal requirement rather than the state one. Property managers in these programs typically document which federal regulations apply to their units so they can identify any areas where state law is displaced.

For Tenants

Section 540:29 means that tenants in federally owned, operated, or subsidized housing may have rights and protections drawn from both federal law and New Hampshire Chapter 540, depending on whether those frameworks align or conflict. Where federal rules override state rules, tenants can look to federal housing program guidelines—such as those administered through HUD—for the governing standards. Tenants who are uncertain which rules apply to their specific housing program may find it helpful to contact a local tenant-rights organization or legal aid office for general information about how this provision affects federally connected rentals.
