N.H. Rev. Stat. Ann. § 205-A: § 205-A:24
Affidavit of Compliance.
Operative Text
I. A park owner may, as shall be appropriate under the circumstances, record in the registry of deeds of the county in which the park is located an affidavit in which the park owner certifies that: (a) The park owner has complied with the requirements of RSA 205-A:21. (b) The sale or transfer of the park is exempted from this chapter pursuant to RSA 205-A:23. II. Any party acquiring an interest in a manufactured housing park, and any and all title insurance companies and attorneys preparing, furnishing, or examining any evidence of title, shall have the absolute right to rely on the truth and accuracy of all statements appearing in such affidavit, and shall be under no obligation to inquire further as to any matter or fact relating to the park owner's compliance with the provisions of this section. It is the purpose and intention of this paragraph to preserve the marketability of title to manufactured housing parks, and, accordingly, the provisions hereof shall be liberally construed in order that all persons may rely on the record title to manufactured housing parks.
New Hampshire Revised Statutes § 205-A:24 establishes a mechanism by which a manufactured housing park owner can record a formal affidavit in the county registry of deeds, certifying either that the owner has met the requirements of RSA 205-A:21 or that the sale qualifies for an exemption under RSA 205-A:23. Once such an affidavit is recorded, any party acquiring an interest in the park — as well as title insurance companies and attorneys reviewing title — is entitled to treat the affidavit's statements as accurate and complete, with no duty to investigate further. The provision is explicitly designed to keep title to manufactured housing parks marketable and is to be interpreted broadly in favor of reliance on the recorded record.
Plain English — not legal advice.
Under § 205-A:24, a park owner who has satisfied the notice and compliance requirements of RSA 205-A:21, or whose transaction qualifies for an exemption under RSA 205-A:23, generally records a sworn affidavit in the county registry of deeds to document that compliance. Operators typically ensure the affidavit accurately reflects the applicable basis for compliance or exemption before recording, since downstream parties — including buyers and title professionals — are entitled to rely on it without further inquiry. Maintaining accurate records of the underlying compliance steps is a common practice that supports the integrity of the affidavit.

Section § 205-A:24 is primarily a title-marketability provision that affects how ownership interests in a manufactured housing park are transferred and documented, but it connects to the broader framework of RSA 205-A:21, which governs the rights of park residents when a park is sold. Residents of a manufactured housing park may want to understand how the affidavit process relates to their protections under RSA 205-A:21, since a recorded affidavit signals that the park owner has certified compliance with — or exemption from — those requirements. Tenants who have questions about whether proper procedures were followed during a park sale can consult a tenant-rights organization or legal aid service familiar with New Hampshire manufactured housing law.
